Bringing this to the top due to recent developments.

Read in the Mail on Sunday today - and subsequently found threads on this site here

about the link up between Phorm and BT and other ISPs.

Anyone who followed the original thread on sysip.net from last year would be interested in this as it is now proven that BT did do some exploratory work with Phorm and it cost me and my business a lot of time and money.

I'm really not happy with this. I got so much wrong information from BT and Phorm which now looks like down right lies.

BT have done a deal with Phorm. The shenanigans of June and July of 2007 were clearly dry runs. I feel like a violated guinea pig :-)

I think there are two separate issues here.

The first is what is going to happen with user browsing data and this new webwise system. This is an issue which affects all BT / VM / TT customers.

The second issue is of course what happened last July. If it indeed was the case that I and others were used as unwitting guinea pigs for any test runs of the service then this is certainly not right.

Elsewhere someone has stated that there could have been a contravention of the Regulation of Investigatory Powers Act namely:

In particular sections 1(1) and 2(2):

1. Unlawful interception.

— (1) It shall be an offence for a person intentionally and without lawful authority to intercept, at any place in the United Kingdom, any communication in the course of its transmission by means of—

(a) a public postal service; or

(b) a public telecommunication system.

2. (2) For the purposes of this Act, but subject to the following provisions of this section, a person intercepts a communication in the course of its transmission by means of a telecommunication system if, and only if, he—

(a) so modifies or interferes with the system, or its operation,

(b) so monitors transmissions made by means of the system, or

(c) so monitors transmissions made by wireless telegraphy to or from apparatus comprised in the system,

as to make some or all of the contents of the communication available, while being transmitted, to a person other than the sender or intended recipient of the communication.

And of course - I did incur a lot of needless expense of which I feel I should be compensated for.

I will see how this issue pans out and will take legal advice.

I've just read about this sysip.net business and, wow, what can I say other than I'm shocked a company like BT (supposedly big enough to exercise as-a-matter-of-course a respect for its people?) could even entertain the idea of implementing a system like this. Unbelievable.

It's good to hear your efforts in realising the truth have been vindicated. I think you have every right to be unhappy about it, I'd be furious personally.

*SYSIP.NET ISSUE - UPDATE*

BT can confirm that we conducted a very small scale technical test of a prototype advertising platform on one exchange in June 2007. The test was specifically conducted to evaluate the functional and technical performance of the platform. Absolutely no personally identifiable information was processed, stored or disclosed during this trial. As with all Service Providers, it is important for BT to ensure that, before any potential new technologies are employed, they are robust and fit for purpose.
