Beings sued over a d/l

I downloaded a game from bitcomet in july and now i have recived a letter saying i am being sued for the download is this correct.

on the letter it shows when the download was started and finished and what program i used to get the file

any help please

Letter was from whom? In the past these letters usually come via the service provider and people are given the option to simply promise to not do it again.

If it says you are going to actually be sued, then it would a very wise thing to actually seek proper legal advice on the content of the letter. It does sound like from your post that you are not denying the copyright infringement.

There is potential for this to actually happen, but it is rare to go after someone for just a single download.

It is from an indepedant solicitor and they want me to pay a large amount of money then it will all go away. i was unsure if i could download the game for free cos i was new to bit comet

Seek legal advice, one important question is how did this independent solictor obtain your details? This could actually be a scam - demanding money and then promising to go away does not sound like the normal letters. Generally people get a warning letter from their ISP asking to confirm things.

If wary of cost of a solicitor the Citizens Advice people are worth a chat to.

No idea where you are in the UK but http://www.stoke-cab.org.uk/ gives the format of the URL's they normally use, and http://www.yellowpages.com/ will probably produce a telephone number in your area.

I would also advice using google to see if others have had a similar letter and what has been said.

I work as part of a Safer Neighbourhood team in a police service on the South coast, I've seen 2 letters recently from people in the area I work along a similar line that aren't legitimate, I have advised the persons that have recieved these ( one doesn't even own a PC or have internet access) to speak to a solicitor and inform Royal Mail Fraud department, who will investigate the true origins of the letter. Hope this helps.

Demand all material evidence from them so you may form a defence.

Don't seek legal advice until you need it. It sounds like a scam.

It may be early so I may be wrong, but with BT Total if someone guesses your username and they have BT Total they can log in as you on their BT Total line, perhaps do the deed and log out.

Now the BT Total authentication logs should be able to ID which line that happened across, but has this actually been done when doing the IP to username lookup?

In summary - even if you think the letter is a scam talk to a local solicitor with a view to verifying the case, non-action if this is not a scam could make things worse

It goes by the phone line doesnt it Mr Saffron ??
I mean it authenticates the line not the username etc

I use a hub with the bog standard username but it authenticates with my phone line !!

That the access is coming from the landline registered (I may be wrong)
