If the customers modem is not restarted, will the line sync rate be renegotiated while both modems are up and running in a normal condition?

I am now seeing DLM increase the speed since the cutover to FTTC / VDSL on 21st April.

The modem router has not been restarted since the 21st, and have seen a number of speed increases:
9999 38791 28-Apr-2017 04:39
9996 34781 27-Apr-2017 08:11
9996 33170 26-Apr-2017 14:01
9996 33065 24-Apr-2017 07:42

Zen Fibre 1 service is quoted as 38Mbps down and 9.5Mbps up, so looks like I am now close to these limits?

You are now pretty close. The actual sync speed limitation is 39999 kbit/s down and 9999 kbit/s up (or possibly 1 higher on each). However, the advertising rules applying to all ISPs mean that they can only quote a speed that at least 10% of customers achieve in practice.

I am on 4dB, DLM tried 3dB but too many errors so I have seen the roll out in north east although it's a fairly new cabinet.

I have been on an SNR of around 1.1/1.3dB for the past 62 days.
But that could be because I am now on Zen GEA FTTC.
