Talk Talk Contract

Hi to all and thanks up front for your time and information. Last summer I agreed a new contract with Talk Talk that would give me my existing package plus an upgrade to their fibre medium for an agreed 12 month price of £32.70. After 2 months I received just a partial discount and then since have received no discount at all and have been paying full price ever since. They say that the discount could only be processed in 3 month increments, despite this there was no full discount on the third month of my new contract. As the agreement was not met would I still be obliged to pay an early leaving fee if I left Talk Talk? I have been offered a good deal with Virgin and would seriously consider it if I was not in hock to Talk Talk.

The agreement was made via live chat, of which I still have a transcript copy.

Today they offered me a £10.75 discount for a 12 month period as of today, then changed it to £8.25. Does this mean that they recognize that the contract has not been upheld? As of yet I have not agreed.

Need more detail!

Which of your figures are per month or per year? How much did you agree per month? How much have you since paid each month?

i was paying just over £35 per month prior to July last year for an essentials package which also included a boost for 1000 mobile minutes for £5 per month.

i was considering staying with talk talk as my original contract was almost up and tried to haggle a deal for an upgrade to include my then 24mb adsl service to their fibre medium service. they offered the fibre medium at £5 per month, rather than the £10 asking price. they already had offered to slash my existing package to £27.70 per month which was also to include the aforementioned boost. so i signed up to what i believe was an 18 month contract with the first 12 months at £32.70, rather than the £40.45 it should have been, with the upgrade to fibre included. the discount should have totaled £7.75 each month.

the first payment due on the 12 month discount plan was due on close of july and saw me charged £32.70 as agreed, this also happened on close of august too. however, in september the discount was reduced to £4.95. as of october last year no discount was included at all and the cost of my package was £40.90 and has been ever since, this now also included an increase of 55p due to the rise in cost of line rental.

they mentioned that their system would only allow them to apply the discount for a 3 month period and i would have to call again after the first 3 months to apply the discount again. despite this i only received a smaller discount on the final third month as shown below.

therefore for the first 12 months of the contract it was agreed:

£32.70 per month

july 2013 = £32.70
aug 2013 = £32.70
sep 2013 = £35.50
oct 2013 = £40.90
nov 2013 = £40.90
dec 2013 = £40.90
jan 2014 = £40.90

Is that per month? Starting when? Backdated or from when you agree? And will they remember it grin?

The £10.75 pm discount for next 12m looks the correct figure to repay you for the overpayments in Sept to Jan:
Overpayments in Sept to Jan = £2.80 + 4 x £7.75 = £33.80
Extra discount over next 12m = 12 x (£10.75 - £7.75) = £36.00
but not the £8.25 pm discount which would leave you out of pocket by £27.80 frown.

Do you know when the line rental went up by 55p? The increase in Sept looks almost like 5 of these rental increases.

Frankly if you have a transcript of them agreeing a £7.75 pm discount for 12m, then you shouldn't have to keep phoning up every 3m and anyway they didn't even do it fully for the 1st 3m.
