Problems leaving Be

I am trying to leave Bethere.co.uk after joining them in Feb 2006. Unfortunately, they won't let me leave without either paying an express disconnect fee of £40 (10 days notice) or a standard disconnect package of 3 months (and associated fees).

I signed up for Be under the impression that there was no notice period and I could leave as I wanted to. I don't see why I should pay for a service I will no longer be using as I have already moved out.

Is there any way out of this? What if I were to just cancel my credit card?

Those are the conditions you signed upto so will have to abide by them, 3 months notice or express cancellation fee.
As for cancelling the card

Be`s terms are very clear, its a 3 month cancellation.

Or pay the Express Fee.

They have AFAIK no hidden Terms regarding leaving.

Canceling your Card will not absolve you from the debt & will likely lead to a collector adding to the debt.

There are numerous posts regarding Be being a 3 month contract, it isn`t hidden, nor is it very hard to find the details.

IMHO... Its a pay up or wait for the eventual debt collection agency letters.

No excuse for not paying.

Unfortunately, it's not BE's fault you didn't read their quite clear terms & conditions, so why should you be able to get out of this?
The fact you "were under the impression" could just mean you thought there was no notice period (which is, by the way, nonexistent in the broadband world - all suppliers have at least a one month notice period).
Or did they actually tell you there was no notice period? Do you have this in writing, or some other proof, or was it really you just not checking what you were about to sign up for?

Fortunately, not too many people are forced to move house with less than 3 months notice, so you are in the minority (not much help for you, but it's OK for everyone else).

Are you moving to somewhere not covered by the BE network (because you do know they do a home move service, where they transfer your account to your new address, and even waive their broadband connection fee)?

Unfortunately I don't have the T&C from the date I signed up on Feb 2006, and I think Be might have changed it in the intervening months.

If you can show me the T&C from that time or know for a fact that it hasn't changed, then I'll cough up. Until then when I signed up, I distinctly recall signing up for a package that allowed me to cancel at any time.

A number of news items from around the launch date ( Sept 2005) mention the 3 month notice such as this and this

Obviously they make no real big fanfare of this disconnection fee until it's time to disconnect. Then it suddenly appears before your eyes. When you sign up, you're so excited that you might get a good, reliable, trustworthy and fast internet service, that you might miss the details. When the reality hits that Be is actually one of the most mediocre ISPs out there, it's way too late.

Trust me though, it's well worth £40; consider it a get-out-of-jail forfeit. Be will also harass you with despicably rude e-mails about returning the "BeBox" so make sure you send it back immediately.

We don't have to. It's your problem, not ours. Maybe next time you enter a contract, you'll keep a copy of what you signed up to ?
