Private road so unable to connect to Fibre Broadband

Gigaclear has just completed installation of fibre to our remote hamlet. We live along an unmade lane that is not owned by us. The owner of the lane is refusing to give Gigaclear a wayleave to lay cable to the 3 properties along the lane. The owner does not live in the area so has no need for fibre. The lane is unmade and never maintained by the owner.
We have right of access and a right to connect to gas electricity water and sewerage but there is no mention of telephone or other services in our deeds.
Is there any legislation that we or gigalcear can use to force the hand of the landowner, as superfast broadband is now becoming a necessity in the modern world.

Not clear from your post, have you checked the deeds for the unmade land to see what is required of the land owner.

What EXACTLY do your deeds or other documents say?

Why not have a connection at the main road and then using solar and batteries run a wifi link to the 3 properties, similar issue here many years ago, took 3 years for landowner to give permission for ISDN line to be laid. No doubt if fibre ever made it this far I would be waiting again so as land next to road is another landowner I would be looking at a box kitted out.

One assumes you have a landline phone service? There is a telephone USO that exists.

As things stand today their is no legislation you can quote that will force the owner to let Gigaclear have access. Some owners will move once they are paid for signing the way leave.

It may be time to pay a lawyer collectively with the other residents to see if any options exist. Alternatively if the land your home is on is freehold and all the gardens link up to the main road, going through the gardens and skipping the road is an option, would need the individual residents to sign a way leave but since a direct benefit unlikely to be problems.
