The appeal by Vtesse to the highest EU court to have a string of previous judgments overturned failed. The court didn't really address the issue of fairness or otherwise in the rating of fibre optics in the UK, but decided that Vtesse had not made the case that they individually had been adversely affected by the judgements or by the rating regime - hence they couldn't consider it.
