Hidden business terms and hiding from tickets

[link to this post]

I have complained to plus.net about the dodgy business terms where they force you to stay on a contract for a year, dispite never mentioning this in their terms and conditions (they only mention 30 days notice).
I complained and now they are just ignoring the tickets. I assume this is so they can stretch out the time it takes to resolve this matter.
I have cancelled the direct debit now as I view my account closed in a few days (they think a few months), what do you think is the best way to try and communicate with them as they don't respond to tickets?

Urm while I normally do have some support for people on contract terms, at the time of signing up to the service, there is usually two options.

Annual contract, or a monthly option which carries a

This is something that we are trying to get clarification on from Plusnet. It looks like Business Contracts are a rolling 1 year contract rather than switching to a monthly after the first year.

Aha - mmm not brilliant, but not uncommon for business connections, I know of other providers that do the same.

Surely if they mention that you only need to give 30 days notice after you have completed your first year then that should stand as that is what the user has signed up to, unless the T's and C's are different for residential and Business products?

Just realised - the link in the current terms and conditions takes you to the archive conditions which should be no longer valid

I don't see any reference to that in the T&C's. There is a reference to 30 days notice and a reference to paying "cancellations charges as set out in your agreement".

The T&C's do not define "cancellation charges", and I do not recall having an "agreement" other than a reference to the T&C's when signing up. I've a feeling that a half-decent lawyer would make mincemeat of the "rolling 1 year contract".

Minimum Contract Periods

Your Minimum Contract Period will be determined by the account type for which you signup. The rules that specify what your Minimum Contract Period are as follows:

1. Business customers enter into a 12 month contract.

2. Residential customers enter into a 1 month contract unless you:

i) specifically choose to sign up to an annual contract account, or
ii) specifically choose to sign up to a 'No Install Fee', 'Deferred Hardware' or 'No Activation Fee' ADSL account options (see below), or
iii) choose to signup to a BT-install ADSL product

- in which cases your Minimum Contract Period is 12 months.

At the end of your contract period, if you do not tell us that you wish to cancel we will automatically renew your contract. Your cancellation request must be given 30 days prior to your contract end date.

That could be construed 2 ways

Mininum contract is 1 year and so 30 days needed for notice

or

at the end of 12 months they will renew your 12 month contract if you do not cancel.

Surely someone from Plusnet can give a definite answer? / awaits PM
