Plus.net email spam and Data Protection Act breach

With the whole plus.net email spam fiasco, would I be correct in assuming that Plus.net could be liable for prosecution in breach of the DPA?
If so would I also be correce in thinking that customers (both current and ex) would have the right to issue legal proceedings against plus.net for damages in respect of their email addresses being disclosed?

To be honest, probably not. They may be liable because of not putting in sufficient safeguards but knowing the way these things work the blame would be put on the attacker not PlusNet. It all comes down to whether e-maill addresses are considered personal information and whether it is deemed that PlusNet had sufficient security in place.
