40-80 kbps upload speed!

My friend's on Virgin cable 10 Mb. For last 2 weeks, after 6 pm, upload speed goes down to 40 to 80 kbps, making net useless. Gaming is laggy and even disconnects. Has to be some sort of throttling as it happens after 6 pm. But 40 kbps is TOO little! That's a stupid amount of throttling.

He hasn't been file sharing either so it couldn't be targetted for that reason. Is this a problem? His net becomes virtually useless after 6 pm. Download is fine at 10 Mb, but upload is between 40-80 kilobits (that's kb, not even kB)!

Assuming it's not an upstream fault it could well be congestion.

Might be an idea to put a call into VM and ask them to take a look
