Thottleing newsgroups non peak times

Has anyone noticed that the Newsgroups are being throttled at non peak times? I have tried Astraweb and Virgins newsgroup, and both at the same time and I have tried all the different ports and the results are below:

4 TH Jan---16 mbit at 12.05 AM
6 TH Jan---32 mbit at 1 PM

full speed today at 1PM--- 50 Mbit at 1.30 PM, also it is at 50 Mbit as I speak.

This is crazy as it says shaping happens between 5PM-12PM?
