Virgin Media ADSL Sued Over Slow Speed

HI

On Friday 20th September 2007, I successful took Virgin Media to the County Courts over their slow ADSL speed. (I was contracted to an "up to 8 meg" service).

Their contract reserves the right for Virgin Media to supply a customer with a speed of anything above, 0 Mbs and up to 8 Mbs. They even reserve the right not to supply a service at all.

The last paragraph of the Terms And Conditions gives Virgin Media the right to say anything they want by any personal or other any media, and this will always be overruled by their Terms And Conditions.

This was ruled to be "Absurd" by the court under the "The Unfair Terms in Consumer Contracts Regulations 1999".

Therefore the court ordered Virgin Media to refund part of the money I had already paid them and all my expenses. They were also ordered to release me from my contract without cost to me and issue me with a MAC number and that my migration to another company should happen without hindrance.

I hope this is enough to convince anyone not to use Virgin Media ADSL.

Good on you, glad you won, however it should be pointed out people investigate what is and isnt allowed in legal terms before they take any ISP to court. You case was pretty clear cut due to their ridiculous terms, which im sure if they havent will be altered very soon.

Consumers in this country have more powers and rights than they know, its just a shame not many will challenge organisations like virgin when the customer is clearly right.

Again well done on winning the day, and hope you have better luck with the new ISP you migrate to.

Hi

My advice is if you are feel your ISP is not providing what you were expecting and you feel they have mislead you in someway, then your ISP should be made accountable for this.

DO NOT BLAME YOURSELF!!

If you have to read the Terms & Conditions 2 or 3 times or you require a legal expert just to understand them, then the company is not being upfront.

JUST BECAUSE IT IN THE TERMS & CONDITIONS DOES NOT MAKE IT RIGHT!!!

What sort of speeds were you getting? I'm on Virgin ADSL 8Mb, but if I'm lucky I get 0.2Mb! This is not much faster than dial up! I'm moving house now but rather than take them with me I'm going to ditch them, even though I'm within contract. I don't believe they're fulfilling their part of the bargain.

My lowest recorded speed was 82 kbs 0.082Mbs

My lowest speed to date on their 8MB ADSL connection is 45Kb/s

I've only had my account fully activated for two week and already I am begining to see tham as a very deceptive IP and have said so in my blog
