Trading standards and FUP

Have any isp's been reported to trading standards for falsely selling products?
If so what was the outcome?

I am referring to an unlimited service being subject to a FUP that limits you between certain hours of the day. I could accept it was unlimited if there were no punishments for non compliance with a FUP but this is not the case so the service has restrictions and limits.

Unlimited is unlimited, there is no FUP in unlimited, hence the lies

The FUP would have been mentioned in the T & C which the OP must have agreed to. The majority of ISP's have FUP's and draw customers' attention to them when they sign up.

I agree this 'unlimited' thing does seem pretty daft!

It's even worse for mobile BB. Virgin for example have phone packages with 'unlimited' data access, but when you read the small print it's actually 750mb per month and then £2 per mb - as far as I can tell!

WHY DON'T THEY JUST SAY "750 MB PER MONTH" ???

Can't see how companies get a away with these claims myself...
It's a shame the UK doesn't have some type of body policing this sort of thing!!!

ofcom part of their remit is to look out for the profits of those they regulate, in other words they cant regulate at a level it will cause significant impact on sales. ASA I believe has some similiar clause.

yes i agree once you have signed your over the barrel and you cant argue the FUP you should have read it. I am on about selling something that isnt unlimited. IT is unlimited depending on my use. That is a condition of limitation therefore not unlimited.

It is a contested service and yes if it is oversold i will notice significant drops in performance when large numbers of users come online that is part of the service.

But ISP's use traffic management during these times to ensure as many users appear to be receiving their desired service. This mangement comes at the expense of another user who is therefore being limited.

The problem is that so many isp's still advertise their products as unlimited when they are nothing of the sort

This is long before anything has been read and signed.
