Apparently it's entirely possible to do so, according to this report. 10th paragraph down it goes...

And, for owners of Intel-based Macs who are still using the older Tiger version of the Mac OS, Apple is officially making Snow Leopard available only in a �boxed set� that includes other software and costs $169. The reasoning is that these folks never paid the $129 back in 2007 to upgrade to Leopard. But here�s a tip: Apple concedes that the $29 Snow Leopard upgrade will work properly on these Tiger-equipped Macs, so you can save the extra $140.

I guess it's Apple's way of admitting Leopard wasn't really finished. XD

Or that they didn't have time to ship two copies. One for upgrades, one for full.

Ian, afaik Archive and Install is the new Install in Place (upgrade) - SL checks what it can use and replaces what it can not, the result being similar to Archive and Install but without the archive folder. Erase and Install was moved to the Disk Utility application inside the installer. Archive and Install as we knew it, is gone.

According to the BBC, Apple say it violates the user agreement

Quite what that would actually mean in practice I've no idea
