Tiscali LLU customers locked in

[link to this post]

According to a PlusNet CS agent quoted on the PUG forum, Tiscali have now stopped issuing MAC keys due to "technical problems" ....so any PlusNetLLU punters waiting to get out of jail are up a creek without a paddle. Presumably this will push up PlusNet's refunds bill too.

You couldn't write this script.

Surely that is illegal Simon? So in effect as folks have contracts with Plusnet (not Tiscali), Plusnet are in breach of they're own T&C's yet again...........Wonder what number we're at now?

It`s a benefit of not signing up to the OFCOM migration Codes of Practice

But Plusnet and Tiscali are members of ISPA, though Plusnet must have broken nearly every single article in the ISPA code of practise..........

Heres a few obvious ones Plusnet has tiddled all over.....

2.3 Honesty
2.3.1 Members shall use their reasonable endeavours to ensure Services (excluding Third Party Content) and Promotional Material are not of a kind that are likely to mislead by inaccuracy, ambiguity, exaggeration, omission or otherwise.
2.4 Fair Trading
2.4.1 In its dealings with consumers, other businesses and each other, Members must act fairly and reasonably at all times.
3.2 Pricing Information
3.2.1 Members must ensure that charges for Services are clearly stated in relevant Promotional Material. Members must make clear whether any such charges quoted are inclusive or exclusive of VAT. Where additional charges, for example on-line charges, are payable this should be stated.
3.2.2 Members must use reasonable endeavours to ensure that textual pricing information relating to charges for Services is accurate, up to date, legible, prominent and presented in such a way that does not require close examination.
4. Data Protection and Privacy
4.1 Members shall comply with UK legislation relating to data protection.
4.2 When registering with the Data Protection Registry, all Members must in their application state that the data may be used for regulatory purposes and that ISPA is a potential user of that information.

Currently, those wanting to switch need to be given a Migration Authorisation Code (MAC), but Ofcom said companies were not always providing this. It proposes making it mandatory for service providers to issue MACs.

According to Ofcom, two of E7even's wholesale suppliers, Tiscali and Netservices, refused to give customers their MACs even though they could no longer access the internet through E7even.

"A spokesman from the Internet Services Providers' Association (ISPA) said there was a voluntary industry scheme at the moment that was set up to make it a lot easier for customers to move - but added that not all ISPs are members of this.

He added the switch to a mandatory scheme would be "a positive thing for competition in the industry" and that the ISPA was planning to participate "fully" in the consultation exercise to give Ofcom the benefit of its expertise and experience. "

However OFCOM's Broadband Service Provider Migration Code of Practice does state the loosing service provider may not refuse to issue a MAC

Anyone know what the specific "technical problems" are for Plusnet/Tiscali no longer issuing LLU Mac codes?

A few months ago I was told (via someone at Zen) that BT have given all LLU ISP's specifc Mac codes (format = LLU123456) which they can generate at will.

However actually processing them involves a time-consuming manual process as there is no automatic notification from BTw when the migration is complete, which is why LLU ISP's prefer not to issue/accept these for the time being.

So its basically a "can't be bothered" approach from Tiscali, and Plusnet isn't prepared to jump on them for it cos they'll lose customers if they do.

This'll be the transparent and open company of plusnet doing its utmost to fulfill customers requirements then.......
