I actually rang the DP Commissioner regarding another issue, and a company must be registered if:

1) They collect personal information for the intention of sales and promotion.

This excludes for billing or invoicing, if it used for the promotion of the company or sales etc, then they have to be registered.

NOW, I have left them for nearly 2.5 years, and all my details are still there, which is unreasonable for them to keep. So therefore if they have only just registered on 18th May, they have infact broken the DPA, as we all know they have been sending sales / promotional emails before this date.

SO Plusnet please answer the following:

1) Why are my details still on there?

2) Can I have the name of your Data Protection Controller and the Postal Address, to write to ask you for an official answer as to why I have my details still on your system.

Please remove my email address immediately, as I do not want any mailings from you.

This is not a dig at any person individually, however it is at the compnay, and I cannot tolerate that you are breaking the law.

Without going into discussion on the rest of your details, I do NOT read the "Company Law Amendment Directive" as requiring the inclusion of the VAT number (unless it is specifically relevant to the communication - i.e. an Invoice)!!

Thats the problem with people who are not legally trained, when they look at things like the DPA and disabilities act.
A lot of the time it is that they think the lawbeen broken but usually there are a lot of reasons why it appears that they have been broken but in fact they have not. Next thing you will be quoting is the Human Rights Laws.
it beggars belief that people who have no training in legal matters start quoting selective lines from laws and acts because it suits their agenda .

I don't actually see the point of asking those question here ! do you think they will actually react to them post on here.....they may not even read the post! I think if you want it sorted, you have to write to them recorded delivery and if you can't be bother doing it then its not that much of a worry for you is it?

I hope you don't think that just because you have posted something on an independent forum that someone from plusnet may or may not read that you have sorted it all out, although it does seem to be a trend starting on here

In my experience, they're much more likely to respond quickly here than they are to a ticket in their support system, which they ignore for days if it suits them.

You may be right (Edit: No. you definitely are. My mistake. I've edited that out). But I don't think there can be much disagreement that at least some of the information should have been on their emails.

Well given that Think Broadband and Microsoft (to name two very quickly) are also guilty, one would expect complaints about any or all of them, since the majority of browsers are supplied by the latter and this argument is occuring on the site of the former.

Encouraging WAI/WCAG/508 is a good thing (I've done it myself), but putting it in the context that Podster did, is simply looking for ammo IMHO.

Anyway, how can you prove that any of the above and/or Plusnet have refused to provide services or haven't taken reasonable steps to attempt to make things easier (in line with DDA/WAI)?

In answer to the last point, because PlusNet added the Captcha after several weeks of the software's release; ie: they are deliberately making it more difficult to use.

This is symptomatic of PlusNet's casual disregard for the laws of the land.
