Mentioning your antidepressant medication is of no importance to this thread.

Was Eclipse Home Option 1 & VM 2Mb
Now O2 standard

You might also put to their ADR body whoever they are that Vivaciti does not make available their written Complaints and ADR Process, as they are required to do, nor their postal address.

T/C

18. Law

The Agreement shall be governed by the laws of England and the parties submit to the non-exclusive jurisdiction of the Courts of England. Our postal address for communications is: Vivaciti Ltd, 319 Sutton Road, Southend on Sea, Essex, SS2 5PF.

Not hard to find.....

12. Termination

12.1 The customer may terminate this agreement after the initial term by giving 30 days written notice to Vivaciti Broadband

Wonder if the Op did this..... As we all know requesting a MAC is not advising them of cancelation.
Most ISP 's stipulate a 30 day notice period ,but quite a few accept issue of a MAC code as that notice period, but if the code ain't used the service continues as normal , IIRC ukonline operated in this way

Never-ending!

T&Cs not, nor contain, Complaints Process.

A ISP cannot prevent cust. migrating even when in dispute. Outstanding contractual obligations, incl. notice, can be settled after migration away.

Did I mention ANYTHING about it stopping the OP leaving......

Was just pointing out some folks don't look very hard for a address..... blush

Perhaps the disputes process falls under the co providing the service as this is a reseller.

You wondered if OP had given notice; I'm pointing out it doesn't matter to the subject matter of this thread.

Complaints/Disputes Processes are rights given to consumers under Consumer Law and Regulations outside and beyond the T&Cs which are covered only by Contract Law.

Addresses footnoted on a form whose body is devoted to "Contact Us" are not very helpful grin. Yes, I did overlook it naturally.

As do a lot of people I speak to on a daily basis.....

My experiance is that most important info is at the bottom of a page. Helpfull or not it is on the contact us page and also in the T/C.

I only brought up notice, as it had never been mentioned and wondered if it had been done. As if not could raise further charges down the line.

Killer thread!!!

Have to agree with the minority view that mentioning illness and drug therapy doses is a complete irrelevance and irritant here.

How many times do we hear that profit margins on BB are tight and that this inhibits further investment? Why shouldn't Vivaciti pursue this?

Seems like someone owes the original ISP some money and the two remaining players should sort out who is going to cough up.

I made the automated 'payment overdue' emails from Vivaciti go into spam folder. I did nothing else about the situation as couldn't cope with it. Got a debt collection letter today. Oh well, lesson learnt....burying ones head in the sand is seldom the best option, but also I do still feel, months down the line that Vivaciti have been wrong, stubborn and mean and bullying in their dealings with me.
I obviously will not be recommending the company to anyone.
