Interesting reading. It does mean that the CPs will have little recourse against OR as PONs are unlikely to ever get congested enough such that they fail to deliver those (low) CIRs.

Most CPs are selling FTTP services with ~50% of advertised speed as 'minimum guaranteed download' (Zen) or 'stay fast guarantee' (BT). This would need 6 1000/110 subscribers on a 32-split PON all pushing it hard to give grounds for complaint. Pretty unlikely, I reckon.

Yes. Here is the small print from when I migrated 900/115 service to TTB:

Minimum guaranteed speed: 450 Mbps*

*Important information regarding minimum guaranteed speed. The enclosed speeds are based on the Business Peak Results (12pm - 2pm) only. Your broadband speeds can vary depending on a number of factors, such as traffic shaping, time of day and the number of devices being used simultaneously on your line, as well as on-premises factors such as the strength of Wi-Fi signal. If you report your speed falling below this minimum guaranteed speed and we are unable to resolve the issue within 30 days, you have the right to cancel your contract without termination charges in line with TalkTalk Business’ commitment to fair competition in the telecoms industry and Ofcom’s voluntary Business Broadband Speeds Code of Practice membership. You would need to contact us on 0800 083 3003 for further details and to discuss your options.
