I just find it strange that after all the hassle and agro that went on with the arguments about who signed up for the unlimited service they go and issue a mail with that sort of statement. It just leads them open to the same sort of problem in future.
Irrespective of the legalities of the situation, it can't be good business practice to set out a position which appears to be clear cut and then rely on the small print to get yourself out of trouble at some future point.
As to whether it's misleading I leave that to others to make up their own mind. I'll just say that if I was new to the net I would have assumed that I could use it as I wished for
